This Chapter establishes and authorizes the dollar thresholds under which Indian Health Service Area/Program Directors or their contracting officer delegatees review and approve proposed contract and grant awards under the authorities under Title I of the Indian Self-Determination and Education Assistance Act (P.L. 93-638). Public Law 93-638 contract and grant actions of the Indian Health Service are to be reviewed and approved prior to award in accordance with the following dollar thresholds:
1/ IHS Headquarters will review and approve all proposed P.L. 93-638 contracts which exceed the maximum dollar threshold authorized in section 1-11.2 for the IHS Area/Program Offices. 2/ All P.L. 93-638 proposed grant awards will only be approved at Headquarters. 1-11.3 Awards shall not be made until approval is granted by the reviewing official identified in IHS 1.11.2. All approvals shall be in writing except that, when time is of the essence, approval may be given verbally and subsequently confirmed in writing. Approvals required hereunder may not be granted on a conditional basis if the reviewing official determines that substantive issues remain to be resolved. All substantive issues must be resolved prior to granting approval. The exercise of the authority under section 106 to make advance payments for any contract under section 103 of P.L. 93-638 is subject to the provisions that (1) there be a prior review and documented recommendation by the Director, Division of Grants and Procurement Management, HRSA, on each proposed advance; and (2) a copy of each approved advanced be submitted (within two weeks of its approval) to the Director, Office of Administrative Management, Office of the Assistance Secretary for Health.
