AUTHORITY DELEGATED AND TO WHOM

Pursuant to the authority vested in the Director, Indian Health Service (IHS), by the Reorganization Order of January 4, 1988, and in accordance with the authority delegated to the Public Health Service (PHS) Agency Heads by the Director, Office of Management, PHS, on August 17, 1987, and subsequently redelegated to the Director of Headquarters Operations, IHS, on September 21, 1989, I hereby delegate to the Associate Director, Office of Administration and Management, IHS, the acquisition authority to conduct the acquisition program of IHS, to be exercised IHS-wide.  This includes the authority to award, modify, administer, and terminate contracts and other acquisition instruments, and to appoint contracting officers.

You are designated the "Head of the Contracting Activity" and shall exercise those authorities in accordance with, and to the extent permitted by the Health and Human Services Acquisition Regulation (HHSAR), Title 48, Code of Federal Regulations, Chapter 3, and the Federal Acquisition Regulation (FAR), Title 48, Code of Federal Regulations, Chapter 1.

REDELEGATIONS

"Head of the Contracting Activity" authorities may be redelegated, but only as specified in the HHSAR, or in the absence of coverage in the HHSAR, the FAR.  Redelegations outside or below the authority levels permitted by the HHSAR, or in the absence of HHSAR coverage, the FAR, are prohibited.

NOTIFICATION OF REDELEGATION

Copies of all redelegations based on this delegation shall be sent to the Associate Director, Office of Administration and Management, IHS, within 30 days of the effective date of this delegation.  They shall include all levels to and including the Principal Official Responsible for Acquisition for IHS.

INFORMATION AND GUIDANCE

These authorities shall be exercised in accordance with legislative, regulatory, policy and procedural provisions, including those under the HHSAR and PHS supplements thereto, the FAR, IHS Contract Policy Letters, and IHS Acquisition Operating Instructions.

PRIOR DELEGATIONS

This delegation supersedes the delegation contained in the Indian Health Manual, Part 1, Chapter 5, Exhibit 1-5.2H-3, Subject:  Acquisition and Related Delegations of Authority, Transmittal Notice 85.5 dated June 28, 1985.

EFFECTIVE DATE

This delegation is effective upon date of signature.
