SUBJECT: Delegation of Authority, Administrative #34, ?Leasing Authorities, Section 102-73.140, Federal Management Regulation?

AUTHORITY DELEGATED

Pursuant to the authority delegated to the Director, Indian Health Service (IHS), on August 19, 1994, by the Deputy Assistant Secretary for Health Management Operations, United States Department of Health and Human Services, and the authority in Section 102-73.140 of the Federal Management Regulation (FMR), I hereby delegate to the officials listed below, the authority to perform for IHS all functions with respect to acquisition of space by lease in buildings and land incidental thereto when any of the following conditions are met:

  1. The space may be leased for no rental, or for a nominal consideration of $1.00 per annum; or
  2. Space for hospitals, including medical clinics; temporary housing, including hotels (does not include temporary duty quarters or employee relocation) and specialized storage/depot facilities for terms, including all options, of up to 20 years; or
  3. Laboratories for terms, including all options, of up to 5 years (prior approval of the General Services Administration (GSA) must be obtained before initiating a leasing action involving 2,500 or more square feet of space); or
  4. Garage space, on a fiscal year basis only; or
  5. Space for short-term use limited to 180 days with extensions granted by GSA on a case-by-case basis.

The authorities allowed in items (d) and (e) above do not preclude a PHS agency from using its own procurement authority to acquire garage space or space for short-term needs with a purchase order, service-type contract.

AUTHORITY TO REDELEGATE

This authority may be redelegated only to those employees who have been adequately trained and warranted as lease contracting officers.

RESTRICTIONS AND LIMITATIONS

The authorities granted herein shall be exercised in accordance with the requirements and limitations of the Federal Property and Administrative Services Act of 1949 as amended; the Budget Enforcement Act of 1990 and Office of Management and Budget (OMB) Bulletin 91-02, Part 8; FMR subpart 101-18.001; and regulations, and other applicable laws including the GSA Acquisition Regulation (GSAR), the Competition in Contracting Act (CICA), and other OMB and IHS requirements.

These authorities may be exercised upon receipt of an approved "Request for Space" form (SF-81) signed by the Director, Division of Engineering Services, Office of Environmental Health and Engineering, IHS.

SUPERSESSION

This delegation supersedes the previous DOA located in the Indian Health Manual, Administrative Delegation #34, "Delegation of Leasing Authorities" dated July 7, 2010.

EFFECTIVE DATE

This delegation is effective on the date of signature.
