CHAPTER 5
DELEGATIONS OF AUTHORITY


SUBJECT:  TO PROPOSE, DECIDE, AND CoNCUR IN ACTIONS UNDER TITLE 5, CODE OF FEDERAL REGULATIONS, "REDUCTION IN GRADE AND REMOVAL BASED ON UNACCEPTABLE PERFORMANCE, PART 432 (5 CFR 432).

Pursuant to the authority delegated to the Public Health Service (PHS) Agency Heads by the Director, Office of Management, PHS, on February 14, 1983, I hereby delegate the authority to propose, decide, and concur in reductions in grade and removals as follows:

  1. The authority to both propose and decide reductions in grade and removals based on unacceptable performance is delegated to the immediate supervisor for all employees under his/her supervision.  Any official superior with line authority over the immediate supervisor may also exercise this authority if he/she chooses to do so.
  2. The authority to concur on the decision to reduce an employee in grade or to remove an employee based on unacceptable performance is delegated to the supervisor next in line over the supervisor who is proposing and deciding the action.  Any official supervisor with line authority over the concurring supervisor may also exercise this authority if he/she chooses to do so.

    NOTE:  The appropriate servicing personnel officer, or his/her designee, must review each proposal and decision letter before issuance to assure compliance with technical and other requirements.

    AUTHORITY TO REDELEGATE

    These authorities may not be redelegated.  All officials who have line authority over the aforementioned supervisors may restrict the above delegations for organizations under their direction if done so in writing.

    EXCLUSION

    This delegation does not apply to HRSA supervisors who are under the line supervision of a Regional Office officials.

    INFORMATION AND GUIDANCE

    Requirements and instructions for exercising these authorities are contained in 5 CFR 432 as supplemented by HHS Personnel Instruction 432-1, Reduction in Grade and Removal Based on Unacceptable Performance.  In the Public Health Service, the proposing and deciding official must be the same person and the concurring official must be a higher level official than the proposing/deciding official.

    PRIOR DELEGATIONS

    This delegation supersedes all previous delegations.

    EFFECTIVE DATE

    This delegation is effective upon date of signature
