Delegation of Authority
SUBJECT : Indian Self-Determination and Education Assistance Act, Title I.
On May 27, 1976, the Administrator, Health Services Administration (HSA) delegated to me, with authority to redelegate, all of the authorities under Title I of the Indian Self-Determination and Education Assistance Act (P.L. 93-638) which were delegated to the Administrator, HSA, by the Assistant Secretary for Health. This delegation included the stipulation that grant and contract related authorities under P.L. 93-638 may be redelegated to field components of the Indian Health Service (IHS) only with the prior concurrence of the Administrator, HSA.
I hereby delegate, with the required concurrence of the Administrator, HSA, the above contract related authorities except for (1) the authority under section 106(b) to make advance payments for any contract under section 103 and (2) the authority to waive provisions of Federal contracting laws or regulations, including the general provisions found at 41 CFR 3-4.6013 and 6014, which is retained by the Director, Indian Health Service to the officials listed hereunder and in accordance with the requirements herein contained:

These authorities shall be exercised in accordance with all applicable regulations issued by the Secretary of Health and Human Services under P.L. 93-638 and in accordance with all other relations issued by the Secretary of Health and Human Services and not waived or amended by the regulations issue under P.L. 93-638 or the Director, Indian Health Service. The dollar thresholds for approving P.L. 93-638 contracts and grants by Indian Health Area/Program Directors is authorized by IHS Manual Part 1 Chapter 11, Authorized Dollar Thresholds for P.L. 93-.638 Contracts and Grant by IHS Area.
This delegation is effective immediately. These authorities may not be further redelegated except that authority to sign the resulting contract documents may be further redelegated to the respective contracting officer servicing the individual delegatee. This delegation supersedes the December 17, 1975, and February 22, 1977, delegations.
