SUBJECT: Delegation of Authority for the Indian Self- Determination and Education Assistance Act, Public Law 93-638, As Amended

Authority Delegated and To Whom

  1. Pursuant to the authority delegated to the Director, Indian Health Service (IHS), by the Acting Assistant Secretary for Health, dated June 30, 1993, and as continued in the reorganization order designating the IHS as an Operating Division reporting directly to the Secretary of Health and Human Services, signed by the Secretary on October 31, 1995, and published in the Federal Register (60 FR 56605) on November 9, 1995, I hereby delegate to the Director of Headquarters Operations, for application IHS-wide, all of the authorities of the Indian Self-Determination and Education Assistance Act, Public Law (P.L.) 93-638, as amended.

Redelegations and Restrictions

  1. The above authorities may be redelegated.
  2. This authority does not include the authority to promulgate regulations under Section 107 of P.L. 93-638, as amended, and the authority to submit reports to Congress, establish advisory committees or national commissions, and appoint members to such committees or commissions.
Prior Delegation
  1. This delegation supersedes the delegation of authority contained in the Indian Health Manual, Part 1, Chapter 5, Delegations of Authority, Subject:  Indian Self-Determination and Education Assistance Act, Title I, Exhibit 1-5.1J, dated November 23, 1988.  Previous redelegations of authority made to officials within IHS may continue in effect to the extent that they are consistent with this delegation and until they are superseded or canceled by appropriate authority.

Effective Date

  1. This delegation is effective upon date of signature.  In addition, I hereby affirm and ratify any actions taken by the Director of Headquarters Operation or his/her subordinates which, in effect, involved the exercise of the authorities delegated herein prior to the effective date of this delegation.
