AUTHORITY DELEGATED

Pursuant to the Authority vested in the Director, Indian Health Service (IHS), by the Reorganization Order of January 4, 1988, (52 FR 47053), which elevated the IHS to a Public Health Service (PHS) Agency, and in accordance with the authority delegated to PHS Agency Heads on July 24, 1979, I hereby delegate the authority to negotiate and decide the use of PHS facilities by qualified academic scientists, engineers, and students.

AUTHORITY TO REDELEGATE

These authorities may be redelegated.

RESTRICTIONS AND LIMITATIONS

This authority may be exercised insofar as it pertains to facilities under the jurisdiction of the Indian Health Service and is in accordance with the provisions of the Department of Health and Human Services, General Administration Manual chapter 13 - 10 and its PHS supplement, as amended.  Those with this authority may determine that the IHS facilities used for research will not significantly detract from or interfere with health services to American Indians or Alaska Natives and has the full understanding, documented approval, and support of the Indian Tribes or Alaska Native villages involved.

All IHS sponsored research pursuant to Indian Health Manual Part 1, Chapter 7, entitled Research Activities, is subject to the approval of the appropriate IHS Area Office Committee on Research or Area Institutional Review Board, and the IHS National Institutional Review Board.

SUPERSESSION

This delegation supersedes the previous delegation of authority located in the Indian Health Manual, Administrative Delegation #31, dated January 23, 1988.

Effective Date

This delegation is effective on the date of signature.
