AUTHORITY DELEGATED

Pursuant to the authority vested in the Director, Indian Health Service (IHS), by the Reorganization Order of January 4, 1988, (52 FR 47053), which elevated the IHS to a Public Health Service Agency, I hereby delegate to the officials listed below, the authority under Section 23116, Title XXIII, Public Health Service (PHS) Act, by Public Law (P.L.) 99-660 to enter into contracts with fiscal agents to:

1. determine the amount payable to persons who, on behalf of IHS, furnish health services to eligible Indians;

2. determine the amount payable to persons who, on behalf of PHS, furnish health services to individuals pursuant to Section 319 or 322 relating to public health emergencies and persons under quarantine respectively;

3. receive, disburse, and account for funds in making payments described in paragraphs (1) and (2);

4. make such audits of records as may be necessary to ensure that these payments are proper; and,

5. perform such additional functions as may he necessary to carry out the functions described in paragraphs (1) through (4).

AUTHORITY TO REDELEGATE

These authorities may not be redelegated.

RESTRICTIONS AND LIMITATIONS

The authorities delegated in or pursuant to this delegation shall be exercised in accordance with Section 23116, Title XXIII, of the PHS Act and any IHS supplements.

The authority to hire fiscal agents may also be exercised by Indian Tribes and Tribal organizations in accordance with the provisions of Section 23116.

SUPERSESSION

This delegation supersedes the previous delegation of authority located in the Indian Health Manual, Delegation of Authority, Administrative #7, dated August 23, 1990.

EFFECTIVE DATE

This delegation is effective on the date of signature.
