Tribal Management of Federal Quarters

SECTION (XX) - QUARTERS MANAGEMENT

[Name of Tribal Health Programs -] Direct Operation.  The [Name of Tribal Health Program] shall be responsible for the operation, management, and maintenance of the facilities owned by the United States government and located at [City], [State], designated as quarters ("the quarters") in accordance with the current [Tribal Health Program Funding Agreement] Quarters policy approved by [Authorizing Indian Health Service Officer's Name].

  1. The [Name of Tribal Health Program] shall be responsible for assigning all [Indian Health Service and Quarters Occupants] and Federal Government employees to quarters under [Name of IHS Area/Service Unit quarter's location]'s jurisdiction.
  2. [Name of Tribal Health Program] shall be responsible for the day to day operations of the quarters under its jurisdiction, including but not limited to:  Routine maintenance and up keep of heating systems, appliances, utilities, furnishings, grounds, and the building structure.
  3. [Name of Tribal Health Program] may establish rental rates and collect rents for federally owned quarters in compliance with section 309 of the Indian Health Care Improvement Act, as amended at 25 U.S.C. § 1638a.
  4. The facilities designated as quarters under subsection (a) shall remain eligible to receive improvement and repair funds to the same extent that all federally-owned quarters used to house personnel in programs of the Indian Health Service are eligible to receive those funds.
