MEMORANDUM REGARDING PHARMACY UNDER THE INDIAN SELF-
DETERMINATION ACT CONTRACTS AND COMPACTS PROGRAMS"
This errata notice rescinds the Indian Health Service (IHS) Special General Memorandum (SGM) No. 2000-02, "Special General Memorandum Regarding Pharmacy under the Indian Self-Determination Act Contracts and Compacts Programs," dated October 31, 2000. The major reasons for rescinding this SGM are:
Special General Memorandum No. 2000-02 was an official response to the findings of an Office of Inspector General audit (CIN: A-01-99-01502) that a Tribe had extended eligibility for the Indian Self Determination Act (ISDA) contracted pharmacy program to a substantial number of the Tribe's employees who were not otherwise eligible for IHS services. As a result, this SGM directed Area Directors to: "?review all ISDA contracts, compacts, and funding agreements and identify those agreements that contained language extending pharmacy benefits inappropriately to non-IHS beneficiaries." This instruction has been accomplished.
The preferred method to obtain guidance regarding the provision of pharmaceuticals to non-beneficiaries is found in the Director, IHS' guidance document for negotiations, a privileged document that is not available for public distribution. Area Directors and Agency Lead Negotiators are directed to contact the Director, Office of Tribal Self-Governance for further guidance.
Please discard your binder copies and any file copies of the SGM at your earliest convenience.
