SUBJECT: Delegation of Authority, Administrative #38, "Real Property"

AUTHORITY DELEGATED

Pursuant to the following authorities delegated to the Director, Indian Health Service (IHS), by the Assistant Secretary for Management and Budget concerning the June 12, 1996, "Delegation of Authority for Real Property," I hereby delegate to the officials listed below, the administrative authorities relating to the purchase, disposal, and transfer of real property for the IHS.

Director, Office of Environmental Health and Engineering
Director, Division of Facilities Operations

AUTHORITY TO REDELEGATE

These authorities may not be redelegated.

INFORMATION AND GUIDANCE

  1. Maintain necessary records to respond to any internal audits or external inquiries from the Congress and control agencies regarding these approvals.
  2. Make timely reports to appropriate officials of any incident that could potentially cause criticism or have a negative impact on the United States Department of Health and Human Services (HHS) or the Secretary of HHS.
  3. The review process (clearance process) must include notifying the functional manager for real property within the Office of the Assistant Secretary for Administration and Management; and
  4. The authorities granted herein shall be exercised under the Federal Property and Administrative Services Act of 1949, as amended, as well as all other applicable statutes, regulations and HHS policy.

SUPERSESSION

This delegation supersedes the previous DOA located in the Indian Health Manual, Administrative Delegation #38, "Real Property," dated August 8, 1996.

EFFECTIVE DATE

This delegation is effective on the date of signature.
