AUTHORITY DELEGATED

Pursuant to authority delegated to the Director, Indian Health Service (IHS) from the Assistant Secretary for Health, dated July 17, 1996, I hereby delegate to the addressees above, the authority of awarding official under Title V of the Indian Self-Determination and Education Assistance Act, as amended (ISDEAA).

RESTRICTIONS AND LIMITATIONS

Restrictions:

This delegation of authority is limited to Contract Disputes Act (CDA) claims on awards made under Title V of the ISDEAA that involve disputes related to funding for contract support costs.  Final decisions on the approval or disapproval of a CDA claim are retained by the IHS Director.

Limited To:

1. Written notification to the Tribe or Tribal organization of the date by which a decision will be rendered on a claim under the CDA;
2. written requests for additional information required in order to adequately evaluate the CDA claim; and
3. written notification to the Tribe or Tribal organization that the letter they submitted under the CDA does not constitute a proper claim.

AUTHORITY TO REDELEGATE

This authority may not be redelegated.

SUPERSESSION

None.

EFFECTIVE DATE

This delegation is effective upon date of signature.
