SUBJECT: Delegation of Authority, Personnel #62, "Personnel Security and Suitability"

AUTHORITY DELEGATIED

This Delegation of Authority (DOA) is pursuant to 25 United States Code (U.S.C.) § 1661 requiring the Director of the Indian Health Service (IHS) to perform all functions of the Secretary of Health and Human Services relating to the maintenance and operation of hospital and health care facilities for Indians, including the planning for, and provision and utilization of health services for Indians.  This DOA is in compliance with the authorities and requirements set forth by Executive Order 13467, "Reforming Processes Related to Suitability for Government Employment, Fitness for Contractor Employees, and Eligibility for Access to Classified National Security Information," dated June 30, 2008, 25 U.S.C. § 3207, "Character Investigations," enacted by Public Law (Pub. L.) 101-630, "Indian Child Protection and Family Violence Prevention Act"; and 25 U.S.C. § 13041, "Requirement for Background Checks," enacted by Pub. L. 101-647, "Crime Control Act of 1990," and 5 Code of Federal Regulations 731.103, "Delegation to Agencies," I hereby delegate the authority to make final adjudicative decisions on suitability for government employment, eligibility fitness for contractor employees, volunteers and all individuals with access to federal buildings and information systems.

AUTHORITY TO REDELEGATE

This authority may be redelegated to Personnel Security Specialists at IHS Headquarters, and Area Personnel Security Representatives at the discretion of the Director, Division of Personnel Security and Ethics, OHR.

INFORMATION AND GUIDANCE

All unfavorable determinations for suitability or eligibility under Pub. L. 101-630 and Pub. L. 101-647, on federal appointees are to be submitted to the Human Resources Office that performs the personnel work for the subject of the determination.  The Human Resources Office will take the appropriate action on the subject based upon the individual rights of the subject and the appointment they are currently serving under.

All unfavorable pre-employment, and fitness determinations for contractors, volunteers and other non-federal individuals are handled by the designated Personnel Security Representatives.

SUPERSESSION

None.

EFFECTIVE DATE

This delegation of authority is effective on the date of signature.
