AUTHORITY TO REDELEGATE

This authority may not be redelegated.

BACKGROUND

On January 14, 1981, the Secretary of HHS delegated to the Assistant Secretary for Health, authorities under Title III of the Public Health Services Act (42 U.S.C. 241 et seq.).  On July 23, 1981, the Assistant Secretary for Health delegated to the Administrator, Health Resources Administration (HRA), Research and Investigation authorities under Title III, Section 301 of the Public Health Services Act (42 U.S.C. 241 et seq.), as amended.

On August 20, 1982, the Health Resources Administration and the Health Services Administration were merged into the Health Resources and Services Administration (HRSA).  The IHS became a bureau within the new HRSA (see 47 FR 38409:  "The programs of the Indian Health Service, Health Services Administration (HSA), are transferred with no change in organization and functions and established as a bureau-level organization in the new HRSA.").

On May 1, 1986, the HRSA Administrator delegated authorities to exercise Section 301, with authority to re-delegate, to HRSA Bureau Directors.  The IHS was later elevated to agency status in 1988 with the passage of the Indian Health Care Improvement Act.  Since there has been no rescission of the above delegations, the IHS Director currently possesses delegated authorities under Title III Section 301.

This delegation is effective upon date of signature.
