Transmittal Notice 25-08
BACKGROUND:
The purpose of this Transmittal Notice (TN) is to transmit a copy of the new Delegation of Authority (DOA), Administrative #57, “Approve the Allocation of the Accreditation Emergency Fund.” This DOA grants to the Deputy Director, IHS, and Deputy Director for Quality Healthcare and Enterprise Risk Management, IHS, the authority to approve or disapprove the allocation of the Accreditation Emergency Funds.
Starting in fiscal year 2016, Congress began appropriating funds to assist the Indian Health Service (IHS) with “accreditation emergencies.” Pub. L. No. 114-113, 129 Stat. 2242, 2565 (2016) (authorizing $2,000,000 for 2016); Pub. L. No. 115-31, 131 Stat. 135, 484 (2017) (authorizing $29,000,000 for 2017, of which up to $4,000,000 was authorized to supplement Purchased/Referred Care); Pub. L. No. 115-141, 132 Stat. 348, 677 (2018); Pub. L. No. 116-6, 133 Stat. 13, 248 (2019); Pub. L. No. 116-94, 133 Stat. 2534, 2731 (2020); Pub. L. No. 116-260, 134 Stat. 1182, 1524 (2021); Pub. L. No. 117-103, 136 Stat. 49, 398 (2022); Pub. L. No. 117-328, 136 Stat. 4459, 4809 (2023); Pub. L. No. 118-42, 138 Stat. 25, 273 (2024). Together, these funds are referred to as the “Accreditation Emergency Fund.” Pursuant to the Indian Health Care Improvement Act, as amended, the IHS Director is authorized to “manage, expend, and obligate all funds appropriated for [IHS].” 25 U.S.C. § 1661(d)(1)(C).
